TERMS & CONDITIONS

According to the HKSAR Government’s latest anti-epidemic measures released on May 3rd 2022. Scheduled Premises  including pleasure vessels are allowed to operate as long both crew members and passengers abide by the social restriction rules. Personnel who contravene the aforementioned regulations may bear legal consequences.

Covid 19 Special Arrangement

​

In the event that the restrictions imposed by the Government in response to COVID19 result in the houseboat rental becoming prohibited on the originally scheduled boarding date, we will arrange to reschedule the rental to a subsequent boarding date on the following terms:

​

  • If the original boarding date is on weekday, the rescheduled day must also be on weekday. If the original boarding date is on the weekend, the rescheduled day must also be on the weekend. 

  • Any difference in rental fee between the rescheduled day and the original reservation date, will not be refunded.

  • Customers may only reschedule the boarding date once, such rescheduled date to be within 6 months from the original boarding date. If the customer has not rescheduled within this period, the customer will be deemed to have forfeited 100% of the rental fee.

  • In the event of rescheduling due to the foregoing, we will not accept any change of houseboat.

  • Unless otherwise provide under these terms and conditions, we will not accept any refund request

Booking

  • Booking has to be made 2 days in advance. Full payment is required to secure the booking 

  • Booking can be made via the Booking Engine on our official website, by using Credit Card. Confirmation by Email or Whatsapp will be sent after rental payment

  • If there is no confirmation from Aberdeen Flair after payment, please kindly let us know.

Cancellation​

  • 50% of the booking will be refunded if cancellation is 21 days prior to the boarding date

  • There will be no refund after 21 days prior to the boarding date

​

Bad Weather Arrangement

  • In the event of Typhoon Signal 1 and 3, or Amber/ Red Rainstorm Warning being issued on the Date of Arrival, the reservation will still remain effective

  • If the ferry is suspended due to Black Rainstorm Warning, Typhoon Signal 8 or above, being issued on the Date of Arrival, the reservation can be changed to another boarding date of the same value. Guests must inform Aberdeen Flair and settle the rescheduling within 7 days from the original boarding date.

Boarding and Disembarkation

  • The houseboat rental period unit is 18 hours 

  • Boarding section content including: 

    • Houseboat rules introduction 

    • Houseboat facilities introduction

  • Boarding time is from 2pm to 5:45pm, Disembarkation time is 11am/12pm (depending on houseboat)

  • There will be assigned boarding time slot(s) given to the guest when the booking has been confirmed. Please select your preferable boarding time slot asap. The priority of boarding time slot selection will be relevant to your booking date. 

  • If your guests would not be arriving at the same time, you could board with the first group of guests for the boarding section, the rest of your guests could get on your houseboat later by local sampan.

  • If you arrive 15 mins later than your selected boarding time, our boarding assistant will assist you as soon as the fellow boarding group has been done.

  • Our staff will contact you via WhatsApp TWO days prior to boarding to facilitate any logistical matters (i.e. Boarding time & final number of guests), and will pick you up at the pier, at the arranged time.

  • Local Sampan operates normally from 7am to 8pm.

  • If you need transportation service after 8pm, please inform us 2 days before boarding. If there is no advance notice, we cannot guarantee the service can be provided immediately.

  • If your guests need to board or get off from the houseboat after 8pm, and there is no serviceable Sampan on that night, we could try arranging speedboat service instead. They charge HKD$500 per trip, for a maximum of 5 people. 

  • We shall keep the information of sampan service as accurate as possible. However, all sampan services are not managed and operated by our company, we shall not be responsible for any fee charged by the service provider for the transportation.

General

  • All our houseboats are registered as pleasure boat with rental licenses at Marine Department and are insured according to the law of Hong Kong

  • According to Hong Kong Shipping Ordinance, for chartering local registered pleasure boats, the customer must sign a charter agreement, and the houseboat can only be used for pleasure purposes (such as parties, experiences and leisure), and guests can use the vessel properly during the rental period

  • The person to whom the vessel is let commits an offence if he does not comply with section 6(5)(b) of the Merchant Shipping (Local Vessels) (Certification and Licensing) Regulation (Cap. 548 sub. leg. D) [Annex.1]

  • We do expect our guests would treat the houseboats with care

  • If the people on board EXCEEDS the agreed number of persons in the booking, we would have the right to request an additional entrance fee of HK$ 1,000 per person or cancel the houseboat rental without refund

  • No smoking and no shoes is allowed inside the boat, smoking is allowed at the outdoor area

  • No breaking of furniture, replacement or repair charges involved if furniture or the boat is damaged

  • Please put your rubbish in the bins provided, and keep the boat clean and tidy during the period of rental

  • Please clean the borrowed kitchenware and tableware properly, otherwise we will charge HK$ 500 as extra cleaning fee

  • The design of the yacht toilet bowl is different from the one we use on land. Do not flush toilet paper / sanitary products into the toilet bowl. Used toilet paper can be flushed in a smaller amount by a few flushes. If severe blockage of the toilet bowl is found, the whole system will need to be dismantled for repair, the highest repairing fee would be charged in HK $1,500.

  • Deposit of $1,500 has to be paid upon arrival via bank transfer only, it will be arranged to return in 3-5 working days via bank transfer only if there is no cleanliness and damage issue after disembarkation (we do not accept to return by credit card bank account). 

  • Customers need to be responsible for their children. We do not offer or provide child minding services. Based on our experience, we recommend having at least 1 adult supervising 1 child to ensure their safety

  • Bringing illegal substances or using illegal substances during the booking is not allowed. If illegal substances are discovered. We will report to the police and no refund for the booking can be made

  • Houseboats could be moved in special case.

 

Safety

  • Customers are solely responsible for their personal safety and that any property they bring on board

  • Please be aware of any potential dangers on board including tripping hazards, moving parts, ropes and bow (front) of the boat and stern (back) of the boat​

 

Damages

  • When the customers disembark, please make sure all furnitures and equipments on board are in the same condition when boarding

  • The customer will be responsible for any damages and property losses caused by any of his/her affiliate members. All equipment or facilities should be used under any applicable regulation of Hong Kong. The customer will hold the sole responsibility for compensation of all damages caused

  • The customer will carry sole responsibility for the passengers and passengers property on the boat, and neither the owner nor any of its officers, servants, agents of any houseboats shall be reliable for any loss or damage to property or loss of life or personal injury whether through negligence or any other cause while on board or during boarding and disembarkation procedure. We will not be held responsible for any loss or damage. However we will assist and report to the police

    

Mechanical Problems

  • If the houseboat is damaged or not safe to use prior to the booking or during the booking and cannot be repaired. We will inform the customer as soon as possible. 

  • An alternative houseboat may be provided as quick as reasonably possible and if no houseboat is available, a re-schedule date will be guaranteed within 6 months of the booking date, refund from the booking is the decision between customer and Aberdeen Flair

 

Indemnification

  • To the maximum extent permitted by applicable law, you agree to release, defend, indemnify, and hold Aberdeen Flair and its affiliates, including but not limited to their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your breach of the above Terms and Conditions, (ii) your interaction with any member staying at the houseboats, including without limitation, any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iii) your breach of any laws, regulations or third party rights

In the event of any dispute over the terms and conditions, the English version shall prevail.
